Web Hosting Terms and Conditions

1. Introduction
1.1 These terms and conditions (“Terms”) govern the provision of web hosting services (“Services”) by Silk Media (“Provider”) to you (“Client”). By purchasing our Services, you agree to these Terms.
1.2 These Terms are governed by the laws of England and Wales and any disputes shall be subject to the exclusive jurisdiction of the English courts.
2. Services Provided
2.1 The Provider shall supply web hosting services as specified in the Client’s selected package.
2.2 The Provider reserves the right to update, modify, or discontinue the Services at its discretion with prior notice.
3. Client Obligations
3.1 The Client agrees to use the Services in compliance with applicable laws and regulations.
3.2 The Client shall not use the Services for any illegal or prohibited activities, including but not limited to:
- Hosting or distributing illegal content.
- Engaging in spamming or sending unsolicited emails.
- Engaging in activities that may compromise server security or integrity.
3.3 The Client is responsible for maintaining the security of their account, including login credentials.
4. Fees and Payment
4.1 The Client agrees to pay all fees as specified in the agreed package, including applicable VAT. There may from time to time be security updates that need to be patched at the Client’s expense.
4.2 Payments are due in advance on a monthly or annual basis unless otherwise agreed.
4.3 Payments for routine maintenance or security patches are due within 14 days.
4.4 Failure to pay fees may result in suspension or termination of the Services.
5. Uptime and Service Availability
5.1 The Provider shall use reasonable efforts to ensure a minimum uptime of 99.9% per calendar month, excluding scheduled maintenance.
5.2 Scheduled maintenance will be notified at least 48 hours in advance.
6. Data Backup and Security
6.1 The Provider conducts regular server backups; however, the Client is responsible for maintaining their own backups of website data.
6.2 The Provider shall not be liable for any data loss or security breaches resulting from the Client’s actions or negligence.
7. Termination
7.1 Either party may terminate the Services with 30 days’ written notice.
7.2 The Provider may terminate or suspend Services without notice if the Client breaches these Terms.
8. Liability
8.1 The Provider’s liability is limited to the amount paid by the Client for the Services during the 12 months preceding the claim.
8.2 The Provider shall not be liable for indirect or consequential damages, including loss of profits, data, or business.
9. Amendments
9.1 The Provider reserves the right to amend these Terms with 30 days’ notice.
9.2 Continued use of the Services constitutes acceptance of the amended Terms.
10. General
10.1 These Terms constitute the entire agreement between the Provider and the Client.
10.2 If any provision of these Terms is deemed unenforceable, the remaining provisions shall remain in full force and effect.
